Terms of Service

1. Acceptance of Terms

By accessing or using EssayAce at essayace.au ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Service Description

EssayAce is an AI-powered essay evaluation platform designed to help students practise for English proficiency exams including PTE Academic and IELTS. The Service provides automated scoring, error detection, improvement suggestions, and model essays generated by artificial intelligence.

EssayAce is a practice and learning tool. It is not a substitute for professional tutoring, official exam preparation courses, or human evaluation.

3. Account Requirements

• You must be at least 13 years of age to create an account and use the Service.
• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
• You may sign in using email/password or Google OAuth. You agree not to share your account with others.

4. Credits and Payments

• EssayAce uses a credit-based system. Each essay submission consumes one credit.
• Credits are sold in packs (for example, 3 credits for $1.99 USD, 10 credits for $4.99 USD). Prices are subject to change.
• Credits are non-transferable between accounts and cannot be exchanged for cash.
• Credits have an expiry period: 3 months from purchase for Starter packs and 6 months for Pro packs. Expired credits cannot be used or refunded.
• New accounts receive a complimentary free credit for trial purposes. Free credits are non-refundable.
• Payments are processed securely by Stripe in USD. By purchasing credits, you agree to Stripe's terms of service.

5. Acceptable Use

You agree not to:

• Submit plagiarised content or content you do not have the right to use
• Use automated scripts, bots, or other tools to submit essays or interact with the Service
• Attempt to reverse-engineer, decompile, or extract the AI scoring algorithms or prompts
• Submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Circumvent rate limits, security measures, or access controls
• Resell, redistribute, or commercially exploit the Service or its outputs without written permission
• Use the Service to generate content for fraudulent purposes, including misrepresenting AI-generated essays as your own original work in academic or professional settings

6. AI Disclaimer

All scores, feedback, error analysis, and model essays are generated by artificial intelligence (AWS Bedrock / Claude). These are estimates intended for practice purposes only and do not represent official exam scores from Pearson (PTE), British Council, or IDP (IELTS), or any other exam body.

AI-generated results may contain inaccuracies, and scores may differ from those awarded in an actual exam. EssayAce makes no guarantee that practising with our platform will result in a specific score on any official examination.

7. Intellectual Property

• Your essays: You retain full ownership of the essay content you submit. By submitting an essay, you grant EssayAce a limited, non-exclusive licence to process, score, and store your essay for the purpose of providing the Service.
• AI-generated content: Model essays, feedback, and suggestions generated by our AI are provided for your personal, non-commercial use only.
• Platform content: The EssayAce name, logo, scoring algorithms, essay topics, user interface, and all other platform content are the intellectual property of EssayAce and may not be copied or reproduced without permission.

8. Service Availability

We strive to keep EssayAce available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including AWS outages). We will make reasonable efforts to notify users of planned downtime.

9. Limitation of Liability

To the maximum extent permitted by law, EssayAce and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or academic opportunities, arising from your use of or inability to use the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to EssayAce in the 12 months preceding the claim.

10. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service or engage in behaviour that is harmful to the platform or other users. You may delete your account at any time by contacting support@essayace.au.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

12. Changes to These Terms

We may modify these Terms of Service at any time. Material changes will be communicated via email or a notice on the platform. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.
